Petition Seeks Clear Distinction Between Aadhaar and Citizenship Documents; Raises Concerns Over Electoral Verification Process

New Delhi (Economy India): The Supreme Court has sought responses from the Central Government, all States, and Union Territories on a petition seeking strict enforcement of Aadhaar’s legal status as a proof of identity rather than proof of citizenship, domicile, residence, or date of birth.

The matter came before a bench headed by Chief Justice Surya Kant and Justice V. Mohana, which issued notices to the Centre and state governments and tagged the petition with similar matters already pending before the court.

Petition Challenges Expanded Use of Aadhaar

The petition, filed by advocate Ashwini Kumar Upadhyay through advocate Ashwani Dubey, argues that Aadhaar is increasingly being used for purposes beyond what is permitted under law.

According to the plea, Aadhaar cards are being accepted as proof of:

🔹 Domicile

🔹 Residential Address

🔹 Date of Birth

for obtaining various government documents and services, despite legal provisions stating otherwise.

Aadhaar Act Clearly Defines Its Purpose

The petition points to Section 9 of the Aadhaar Act, 2016, which explicitly states that Aadhaar shall not be treated as proof of citizenship or domicile.

It also refers to a Unique Identification Authority of India (UIDAI) clarification issued in August 2023, which stated that Aadhaar serves only as proof of identity and does not establish citizenship, place of residence, or date of birth.

The petitioner contends that despite these provisions, Aadhaar continues to be widely accepted for purposes beyond identity verification.

Concerns Raised Over Voter Registration Process

A key concern highlighted in the petition relates to the use of Aadhaar in Form-6, the application form used for new voter registration.

The plea argues that Aadhaar is being used as supporting documentation for age and residence verification, which may not align with existing legal provisions under:

📜 Representation of the People Act, 1950

📜 Article 14 of the Constitution of India

According to the petitioner, the current verification framework may not be sufficiently robust to prevent ineligible individuals from entering electoral databases.

Allegations Regarding Illegal Immigration

The petition further claims that the widespread acceptance of Aadhaar as proof of residence and identity may enable illegal immigrants and infiltrators to obtain additional documents, including:

The plea argues that stronger verification mechanisms are required to maintain the integrity of official records and public databases.

Demand for Electoral Verification Reforms

In addition to restricting Aadhaar’s usage, the petition seeks broader reforms in electoral verification procedures.

Among its recommendations is the creation of a high-powered monitoring committee comprising:

💻 Cybersecurity experts

🔍 Digital forensic specialists

The proposed panel would oversee improvements in identity verification systems and recommend safeguards against misuse.

The case raises important questions regarding:

✔️ Document verification standards

✔️ Balancing administrative convenience with legal safeguards

The Supreme Court’s decision to seek responses from the Centre and States marks a significant development in the ongoing debate over Aadhaar’s role in public administration and electoral processes. The case could lead to greater clarity on the legal status of Aadhaar and establish stricter guidelines on how it can be used by government agencies, institutions, and citizens across India.
