Delhi High Court Orders Google to Pay ₹30 Lakh Damages Over Hindware Trademark Misuse

Court Restrains Google from Using ‘Hindware’ Trademark as Advertising Keyword Under AdWords Programme

NEW DELHI (Economy India): The Delhi High Court has directed Google LLC and Google India to pay a total of ₹30 lakh in damages to sanitaryware major Hindware for using the company’s trademark as keywords under its AdWords advertising programme.

In a significant trademark infringement ruling, Justice Mini Pushkarna held that the use of Hindware’s registered trademarks as advertising keywords amounted to taking an “unfair advantage” under the provisions of the Trade Marks Act.

Court Restrains Use of Hindware Keywords

The court restrained Google from using terms such as:

  • Hindware
  • Hindware Sanitaryware
  • Hindware Sanitary
  • Hindware Sanitaryware India

as advertising keywords on its platform.

The ruling came while deciding two separate trademark infringement suits filed by Hindware Ltd against Google.

₹30 Lakh Damages Awarded

In the judgment dated May 22, the court awarded nominal damages of ₹15 lakh in each of the two cases, taking the total compensation to ₹30 lakh.

“This Court awards nominal damages of ₹15 lakhs each in the present suits, totalling ₹30 lakhs in favour of the plaintiff,” the court observed.

The judgment further directed Google LLC and Google India to pay the amount within eight weeks.

Trademark Protection in Digital Advertising

The case highlights growing legal scrutiny surrounding the use of registered trademarks in online advertising and search engine marketing.

Trademark owners have increasingly raised concerns that competitors or advertising platforms may derive commercial benefits by using established brand names as search keywords, potentially causing consumer confusion and unfair commercial advantage.

The Delhi High Court observed that such usage can impact the exclusive rights enjoyed by trademark holders under Indian law.

Significance for Digital Advertising Industry

Legal experts believe the judgment could have broader implications for digital advertising platforms and businesses that rely on keyword-based marketing strategies.

The ruling reinforces the importance of protecting intellectual property rights in the digital ecosystem and may influence future disputes involving search engine advertising and trademark usage.

Companies operating online advertising platforms may now face greater scrutiny regarding the use of registered brand names as advertising triggers or sponsored search keywords.
